Illinois DUI Law: The Basics

Under 625 ILCS 5/11-501, you can be charged with DUI in Illinois if you drive while:

  • Your blood alcohol concentration (BAC) is 0.08% or higher
  • You are under the influence of alcohol
  • You are under the influence of drugs
  • Your BAC is 0.04%+ while driving a commercial vehicle

DUI Penalties in Illinois

First DUI: Class A Misdemeanor - Up to 364 days jail, 1 year license revocation

Second DUI: Class A Misdemeanor - 5 days mandatory jail, 5 years license revocation

Third DUI: Class 2 Felony - 3-7 years prison, 10 years license revocation

Fourth+ DUI: Class 2 or X Felony - Up to 30 years prison, Lifetime license revocation
